- Platform Usage
Yogyan provides its platform (comprising mobile applications, websites, and web-based applications) under the governance of Yogyan Inc. (“Yogyan Inc.”) and its affiliated entities, including but not limited to Yogyan India. Together, these entities will be referred to as “Yogyan.” The platform enables users with verified accounts to explore and apply for job opportunities listed by independent third-party employers (“Users”).
By accessing and using the Yogyan Platform, users agree to be bound by these Terms of Service and any related rules, regulations, or terms of use applicable to the services offered by Yogyan (“Yogyan Services”).
Yogyan retains the right to modify these Terms of Service at any time, and such modifications will be communicated via the platform or other means, such as email notifications. Continued use of the Yogyan Platform and Services signifies the user’s acceptance of any changes made.
Yogyan may also exercise its discretion to:
- Restrict or suspend access to the platform or services
- Modify or terminate any aspect of the platform
- Reject or remove any user-submitted content
- Deactivate or delete user accounts, along with associated data and files
- Update practices or impose limits on platform use
Any breach of these Terms by a user may result in their account suspension or removal, with necessary legal actions taken.
In cases where a user pays a platform fee in advance for Yogyan Services, a refund will be processed if the suspension or removal results from Yogyan’s errors or oversights.
- User Participation
By utilizing the Yogyan Platform, users may browse and apply for job listings posted by employers. To submit an application, users must provide accurate details about their education, qualifications, experience, and skillset. While Yogyan does not condone discrimination, certain jobs may have gender-specific requirements, which are set by the employers, not Yogyan.
Users are expected to ensure that all shared information is truthful and accurate. Providing false or misleading details may result in suspension or removal from the platform. Job applications will remain active for 60 days, after which they will be archived, and employers will no longer have access to them. However, users can reapply to job postings if still available.
Users must comply with the Code of Conduct outlined by Yogyan while using the platform and services.
- Intellectual Property Rights
Yogyan retains all intellectual property rights related to the platform’s software, content, advertisements, logos, images, and other materials. Users are prohibited from modifying, reproducing, or distributing any content without prior written consent from Yogyan.
Users remain responsible for the content they upload or share on the platform. By submitting content, users guarantee that they hold the rights to it and that it does not infringe upon any third-party rights. Yogyan reserves the right to remove any content that violates these terms.
Users grant Yogyan and its affiliates a global, royalty-free, non-exclusive license to use, display, and distribute their content for platform-related purposes, including promotion, distribution, and storage.
- Third-Party Links and Services
The Yogyan Platform may contain links to third-party websites or mobile applications. These links are provided for convenience and do not imply endorsement. Yogyan is not responsible for the content or activities on third-party sites. Users should review the terms and conditions of these external services before engaging with them.
Any interactions or transactions between users and third-party service providers, such as employers or payment processors, are solely between the user and the third party. Yogyan assumes no liability for such transactions.
- Privacy Policy
The personal data collected from users, including but not limited to registration information, email addresses, phone numbers, and payment details, is subject to Yogyan’s Privacy Policy. We do not share your personal data with third parties without your consent, except as outlined in our policy.
Users are responsible for safeguarding the personal information shared with Yogyan and must not transfer or disclose it to unauthorized parties.
- User Conduct
Users agree to comply with all terms, regulations, and conduct guidelines established by Yogyan. Failure to comply may result in suspension or removal from the platform.
Users are expected to provide truthful, accurate, and up-to-date information. They must not operate multiple accounts or engage in activities that could compromise the platform’s integrity, including using unauthorized software, bots, or other disruptive tools.
Users agree not to engage in harmful behavior such as:
- Harassment, defamation, or offensive actions
- Distributing malicious software
- Violating the legal rights of others
Yogyan reserves the right to take appropriate action if a user violates these terms or engages in prohibited conduct.
- Eligibility Criteria
The Yogyan Platform is exclusively available to individuals who are above the age of 18.
Participation is restricted to residents of India only.
Individuals who wish to engage with the Yogyan Platform must possess a valid email address and/or mobile phone number.
Yogyan reserves the right to restrict access to its services if any individual is found to violate these Terms of Service or the Code of Conduct.
Only those who have successfully registered on the Yogyan Platform are permitted to post job listings.
- Dispute Resolution Process
Should any dispute arise in relation to the Yogyan Services provided via the Yogyan Platform, including issues concerning the validity, interpretation, or enforceability of these Terms of Service or any associated rights and obligations, the parties involved shall strive to resolve the dispute amicably within 30 days from the written communication of the dispute.
If an amicable resolution is not achieved within the stipulated period, either party may initiate arbitration proceedings. The dispute shall be resolved by a sole arbitrator, appointed in accordance with the Delhi International Arbitration Centre (“DIAC Rules”). The arbitration shall take place in New Delhi, with proceedings conducted in English, and governed by Indian law.
Parties retain the right to seek interim or permanent equitable relief from the courts in New Delhi, which shall have exclusive jurisdiction over any disputes that may require injunctive or other relief. The pursuit of such remedies does not waive the parties’ obligation to resolve any further issues through arbitration.
The arbitration decision will be final and binding.
- Release and Liability Limitations
Accessing the Yogyan Platform and its associated services is undertaken at the Job Posters’ own discretion and risk. Yogyan shall not be held liable for any loss or damage incurred by Job Posters or third parties during their use of the platform.
By engaging with the Yogyan Platform, Job Posters agree to release and indemnify Yogyan, its directors, employees, partners, associates, and licensors from any liability, including for personal injury or property damage, arising from their use of the platform.
Yogyan assumes no liability for errors or omissions related to data or information published on the platform, whether on behalf of Yogyan or third parties.
Job Posters will be solely responsible for the consequences of any illegal acts or failure to comply with the Terms of Service, including the submission of incorrect personal information. In such cases, Job Posters agree to fully indemnify and defend Yogyan from any resulting claims, including legal costs.
Job Posters further agree to hold Yogyan harmless from any third-party claims arising from their engagement with the platform. Under no circumstances shall Yogyan be liable for any actions or omissions related to a Job Poster’s use of the platform.
- Disclaimers
To the extent permitted by law, neither Yogyan nor its affiliates, employees, partners, or professional advisors will be held responsible for the deletion, failure to store, misdelivery, or delayed delivery of any materials or information.
Yogyan makes no guarantee regarding the quality of the platform, the servers, or any products and services provided, nor does it guarantee that the platform will meet the Job Posters’ requirements or be free from errors or interruptions.
Any materials downloaded or accessed through the Yogyan Platform are done so at the Job Poster’s own risk. Yogyan will not be liable for any damage to the Job Poster’s computer systems or data loss that results from downloading such materials.
While Yogyan endeavors to maintain a secure and error-free platform, no warranty is made that the platform will be uninterrupted, secure, or free from errors. The results obtained from the platform may not always be reliable or accurate, and the quality of any services or products purchased through the platform may not meet the Job Posters’ expectations.
In the event of any errors, Yogyan reserves the right to correct the issue by adjusting payments or deducting erroneous amounts from Job Posters’ accounts. Affected parties will be notified accordingly.
To the fullest extent permissible by law, Yogyan and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the platform, even if Yogyan has been advised of the possibility of such damages.
If any service offered on the Yogyan Platform requires approval from a governmental or regulatory authority, and such approval is denied, the service may be cancelled or terminated. In such cases, Job Posters will not be entitled to any claims.
In the event of suspension or termination of any Yogyan service, Job Posters will not be entitled to any compensation or claims.
- Mechanism for Addressing Grievances
In the event that a User has any complaints or grievances related to:
(i) Content that the User believes to be in violation of these Terms (excluding Intellectual Property Rights infringements),
(ii) Access to the Yogyan Platform,
(iii) Any Content that the User considers to be obscene, defamatory, or a form of impersonation (including but not limited to digitally altered images),
the User should submit a detailed grievance to: info@2xf.5af.myftpupload.com.
The grievance should include the following details:
- Full Name and Contact Information: Name, address, contact number, and email address.
- Relation to the Issue: Specify whether the User is the complainant or acting on behalf of another affected party.
- Details of the Aggrieved Party: If applicable, the name and age of the individual who has been harmed or affected, along with a statement authorizing the User to act on their behalf and provide their personal details.
- Description of the Grievance: A clear explanation of the complaint, with specific identification of the relevant Content in question.
- Good Faith Statement: A declaration that the User, in good faith, believes the Content in question breaches the Terms and Conditions.
- Accuracy Confirmation: A statement affirming the accuracy of the information provided in the grievance.
Yogyan upholds and respects the Intellectual Property Rights of all individuals and entities. All trademarks, logos, and proprietary content associated with the Yogyan Platform belong to their respective owners. If Users observe any potential infringements of Intellectual Property Rights on the Platform, they are requested to notify us via email at info@2xf.5af.myftpupload.com, including the following information:
- Identification of the Copyrighted Material: Clear description of the copyrighted work believed to have been infringed.
- Identification of Infringing Content: Specific identification of the material believed to infringe on the copyright, hosted on the Yogyan Platform.
- Contact Information: Name, address, email, and phone number of the notifying User.
- Good Faith Statement: A declaration confirming the User’s belief that the use of the copyrighted material on the platform is unauthorized.
- Accuracy Confirmation: A statement asserting the truthfulness of the information provided and confirmation that the signatory is authorized to act on behalf of the copyright holder.
- Signature: The User’s signature or the signature of the User’s authorized agent.
Upon receipt of such a grievance or notice, Yogyan reserves the right to investigate and take appropriate action, which may include reaching out to the User for further clarification. The User is expected to cooperate promptly with the investigation to facilitate a timely resolution.
